      I spoke with Giancarlo DiFazio's father this afternoon, and the trial of Gian's widow has been postponed AGAIN. January 6, 2020 is the new court date. Hopefully there will be no more delays, and justice will be served.

      I noticed that Giancarlo's dad, Nino, has become a member of TrumpetBoards, so anyone wishing to communicate with him will be able to do so by starting a chat with difazio.

          The trial of Lynn Fogarty began last Monday. Jury selection took the better part of three days, due to a special request granted to the defense attorney by the Judge. The jury did not hear the case, as the defendant, as a result of a plea bargain, pleaded guilty to the crime of Voluntary Manslaughter rather than be tried for First Degree Murder. Her sentencing is scheduled for April 3 of this year. The possibilities/options range from 1 - 10 years in prison.

                I spoke with Giancarlo's dad a few minutes ago, and he said that the sentencing of Lynn Fogarty will take place as scheduled on July 1, at 9:00 AM at York County Circuit Court, 300 Ballard St., Yorktown, VA 23690. COVID-19 guidelines will be followed. Hopefully there will be no more delays and that the judge will hand down an appropriate sentence.

                  I somehow ended up as jury foreman of a murder trial about 5-6 years ago. It was intriguing, amazing, heart-rending, exhausting, and about the most stressful week of my life. (Only a week because the defendant changed his plea to guilty on Day 2, so we moved to sentencing). The case involved a husband/wife, and it was just painful all around. The lawyers were a complete dog and pony show, and all the private dirty laundry was aired out in court, stuff that was pertinent and relevant to the case, but stuff that should never have been any of my business. Two flawed and hurting people struggling to reconcile their personal issues until it ended in disaster. Death is a part of life, but man.... we weren't created to kill each other.

                    Yeah. I saw a case of child molestation. Made me physically sick.

                      Sadly, I see these cases in my office much too often. I report the all to Children's Protective Services.

                        According to Giancarlo's father, after a day in court that was prolonged by Lynn Fogarty's attorney's pleas, questions, motions, and objections, some of them absurd, the judge sentenced her to the maximum allowable term: 10 years. Unfortunately, he then suspended 6-1/2 years of the sentence, committing the killer to 3-1/2 years in prison. This enraged her attorney, who had tried to get her punishment reduced to a fine of $2500.
